2008 Contest Rules
    Announcement!


    Operation Dialogue has changed the final date of the quiz to Monday, March 3, 2008 at 10:00 a.m EST. Please login then to find your score. The draw will take place Wednesday March 5. Participants will find out if they have won by logging on to their account on Friday, Mar 7, 2008


    Eligibility

  1. The contest is open to:
    1. All citizens or permanent residents of Canada who are currently residing in a jurisdiction where this contest is permitted, who will be eligible to be registered as a student at a "Qualified Institution", as defined below, by September of 2008, except people who have won a Talk About Canada Scholarship in previous years. These students will be eligible to win the Talk About Canada Scholarship prizes as defined hereunder; AND
    2. Any student attending a Registered School, (as defined hereunder) who is not in his or her final year at such educational institution. These students are eligible to win a junior prize, as described below; AND
    3. Registered Schools, as defined hereunder. Registered schools are eligible to win Registered School prizes, as described below.

    Definitions

  2. Contest Sponsors

    The term "Contest Sponsors" will include Operation Dialogue and any other entities mentioned in conjunction with this contest or deemed to be supporting or assisting with this contest in any way.

  3. Registered School

    A "Registered School" for the purposes of this document will be defined as a school whose student council or other school club, school team or school organization or, in Quebec, person who has agreed to promote the contest in their school in order to raise money and has registered with Operation Dialogue before the contest. Their names will be on a drop down list on the Students' Registration page of the Talk About Canada Scholarship Quiz.

    You do not have to participate with a registered school to be eligible to win in the Talk About CanadaTM scholarship quiz.

  4. Qualified Institution

    A "Qualified Institution" is one that is defined as a post-secondary educational institution for the purposes of an Education Assistance Payment under the CCRA’s requirements for an RESP.

  5. General Provisions

  6. This contest is not open to employees, representatives, agents and family members of Operation Dialogue or the Operation Dialogue Board, nor any persons with whom they are domiciled.

  7. If the contestant is under the age of majority in their province or territory we are legally required to get parental consent. Students will be asked if they have received consent from their parents when they register. If any winner is a minor, the parent/guardian must accept the prize on the behalf of the minor and execute all necessary documents.

  8. By indicating that you are supporting a Registered School you are giving us permission to allow the organizers of the Talk About Canada fundraising program in your school to see your name and the number of questions you have answered.

  9. The names and schools of the winners will be posted on Operation Dialogue's website and may be announced otherwise. By participating each contestant authorizes Operation Dialogue to use his or her name and the school name without any further compensation. Odds of winning the prize will depend on the total number of entries received. By submitting an entry, each contestant accepts the contest rules and regulations. All decisions of the judges are final. Operation Dialogue will not be required to reveal individual scores or what names were eligible for the draw. The contest is governed by the laws of Ontario and is void where prohibited by law. Operation Dialogue reserves the right to terminate or withdraw the contest at any time, without prior notice, subject to the jurisdiction of the Régie des alcools, des courses et des jeux in Québec.

  10. Operation Dialogue and other Contest Sponsors are not responsible for any online communication problems. Any late, lost, misdirected, incomplete or illegible entry forms or questionnaires will be void. Operation Dialogue and any other Contest Sponsors shall not be liable.

  11. In the Province of Quebec, any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.

  12. Operation Dialogue will not share the participants' personal information with third parties without obtaining prior consent.

  13. Operation Dialogue reserves the right to change the wording of a question or provide a different link at its own discretion.

  14. Prizes

  15. Scholarship Prizes

    1. Only students who achieve a score of 50 score on the questionnaire available at www.talkaboutcanada.ca or www.discussionsurlecanada.ca between 10:00 A.M. EST, January 14, 2008 and 10:00 A.M. EST, February 25, 2008 are eligible to win the Scholarship Prizes.
    2. There will be forty (40) $500 prizes, twenty (20) $1000 prizes and one (1) $5000 prize.
    3. Prizes will be in the form of tuition which will be paid directly to the "Qualified Institution of" the winner's choice. The winner must apply for tuition and begin a program at the Qualified Institution no later than September 30, 2009 or the prize will be forfeited. If any portion of the prize is still outstanding it will be applied to tuition in subsequent years. However, any portion of the prize not paid out as tuition by September 30, 2012 will be forfeited.
    4. Prizes cannot be transferred to another person and cannot be substituted for another prize.
    5. Only one scholarship will be awarded per contestant.
    6. All taxes, issuance fees or other charges arising from acceptance of the prize and not described herein as included in the Prize are the sole responsibility of the winner.

  16. Junior Prizes


    1. Students who are attending a Registered School and are not in their graduating year will be eligible to win one of twenty (20) $100 prizes if they achieve a score of 50 on the questionnaire available at www.talkaboutcanada.ca and www.discussionsurlecanada.ca between 10:00 A.M. EST, January 14, 2008 and 10:00 A.M. EST, February 25, 2008.
    2. Only one prize will be awarded per contestant.
    3. All taxes, issuance fees or other charges arising from acceptance of the prize and not described herein as included in the Prize are the sole responsibility of the winner.

  17. Registered School Prizes

    1. The ten Registered Schools who get the most students to support them when they register will earn bonus payments of $200 each.
    2. All taxes, issuance fees or other charges arising from acceptance of the prize and not described herein as included in the Prize are the sole responsibility of the winner.

    Contest Period

  18. The contest will be made available online at www.talkaboutcanada.ca and www.discussionsurlecanada.ca at 10:00 AM Eastern Standard Time, January 14, 2008 and will end at 10:00 A.M. EST, February 25, 2008. No entries will be accepted after midnight, Pacific Standard Time, February 25, 2008. Operation Dialogue reserves the right to extend the period of the contest and any related dates at its own discretion.

  19. Registration

  20. Scholarship Prize Contestants

    1. In order to enter the contest, each contestant must complete an entry form on-line at www.talkaboutcanada.ca or at www.discussionsurlecanada.ca after the contest opens on January 14, 2008.
    2. The contestant will be required to submit his/her e-mail address, full name, date of birth, the first three characters of his/her postal code, the name of his/her school and the city and province in which the school is located and a password in order to enter the contest. Postsecondary students must provide their phone number. All mandatory fields in the entry form must be completed.
    3. There is a limit of one entry per person.

  21. Junior Prize Contestants

    1. In order to enter the contest, each contestant must complete an entry form on-line at www.talkaboutcanada.ca or at www.discussionsurlecanada.ca after the contest opens on January 14, 2008.
    2. The contestant will be required to submit his/her e-mail address, full name, date of birth, the first three characters of his/her postal code, the name of his or her school and the city and province in which the school is located and a password in order to enter the contest.   22. Registered School Contestants

    In order to register, a member of a student organization or teacher must contact Operation Dialogue at 416-364-8863 or janderson@operation-dialogue.com and request that the school be registered. Operation Dialogue reserves the right to accept or reject the request.

  23. Selection of Winners

  24. Scholarship Prizes

    Forty (40) $500 prize winners, twenty (20) $1000 prize winners and one (1) $5000 prize winner will be randomly selected from among the questionnaires submitted which have all the questions correctly answered. The first name drawn will be awarded the $5000 prize. The next twenty (20) will each be awarded a $1000 scholarship. The last forty (40) entries drawn will each be awarded a $500 scholarship. The draw will be held at 66 Wellington Street W., 31st Floor, Toronto, ON on February 27, 2008 at 1:00 P.M. Eastern Standard Time.

  25. Junior Prizes

    The names of twenty (20) winners will be chosen at random from the questionnaires submitted, which have fifty questions correctly answered, by secondary students who are not graduating this year. The draw will be held at 66 Wellington Street W., 31st Floor, Toronto, ON on February 27, 2008 at 1:00 P.M. Eastern Standard Time.

  26. Registered School Prizes

    Operation Dialogue will calculate the total number of entries to be applied to each school that registered and determine which ten schools had the most number of students. If there is a tie for last place, the prize will be divided between the tying schools.

    2. Students will find out if they have won by logging on to their account on Friday, February 29, 2008.
    3. The selected contestants must comply with the Official Rules and Regulations, correctly complete the questionnaire, and sign and return a release form confirming compliance with these contest rules, acceptance of the prize as awarded and releasing Operation Dialogue and other Contest Sponsors from all liability before receiving the prize.
    4. Students will be required to provide proof of age.
    5. If any winner is a minor, their parent/guardian must accept the prize on their behalf and execute all necessary documents.
    6. Each winner must agree to sign a declaration and release form confirming acceptance of the prize as awarded, confirming compliance with the terms and conditions and releasing Operation Dialogue and other Contest Sponsors from any liability before receiving the prize.
    7. Prizes will be in the form of tuition which will be paid directly to an educational institution of the winner's choice which qualifies under the Canada Customs and Revenue Agency rules for Registered Education Savings Plans. The winner must send Operation Dialogue a copy of the institution's statement of fees as proof that he or she is registered and request that Operation Dialogue pay the amount of his or her prize to the institution. The student must apply prior to September 30, 2009 or the prize will be forfeited. If any portion of the prize is still outstanding it may be applied to tuition in subsequent years until June 30, 2012.
    8. All taxes, issuance fees or other charges arising from acceptance of the prize and not described herein as included in the Prize are the sole responsibility of the winner.
    9. Prizes cannot be transferred to another person and cannot be substituted for another prize.
    10. If the selected contestant cannot be contacted, or does not fulfill the above requirements before 5:00 P.M. Eastern Standard Time, March 5 , 2008, the prize will be forfeited by the selected contestant and an alternate contestant may be selected. Operation Dialogue and other Contest Sponsors shall be released and discharged from any liability or responsibility in this regard.
    11. If appropriate documentation has not been received by Operation Dialogue by March 5, 2008 , the prize will be forfeited.
    12. If the winner does not begin a program at a qualified institution by September 30, 2009 the prize will be forfeited.
    13. If any portion of the prize is still outstanding as of June 30, 2012 it will be forfeited.


  29. Junior Prizes

    1. Limit of one (1) prize per family, per household, and per address.
    2. The prize will be $100 which will be payable to the twenty (20) winners upon fulfillment of the following conditions.
    3. The selected contestants must comply with the Official Rules and Regulations, correctly complete the questionnaire, and sign and return a release form confirming compliance with these contest rules, acceptance of the prize as awarded and releasing Operation Dialogue and other Contest Sponsors from all liability before receiving the prize.
    4. Students will find out if they have won by logging on to their account on Friday, February 29, 2008.
    5. Students will be required to provide proof of age.
    6. If the winner is a minor, his or her parent or guardian must accept the prize on his or her behalf and execute all necessary documents.
    7. Each winner must agree to sign a declaration and release form confirming acceptance of the prize as awarded, confirming compliance with the terms and conditions and releasing Operation Dialogue and other Contest Sponsors from any liability before receiving the prize.
    8. All taxes, issuance fees or other charges arising from acceptance of the prize and not described herein as included in the Prize are the sole responsibility of the winner.
    9. Prizes cannot be transferred to another person and cannot be substituted for another prize.
    10. If the selected contestant cannot be contacted, or does not fulfill the above requirements before 5:00 P.M. Eastern Standard Time, March 5 , 2008, the prize will be forfeited by the selected contestant and an alternate contestant will be selected. Operation Dialogue and other Contest Sponsors shall be released and discharged from any liability or responsibility in this regard.
    11. If appropriate documentation has not been received by March 5, 2008, the prize will be forfeited.


  30. Registered School Prizes

    1. The prizes will be paid either to the school or to the school organization promoting the contest, not to an individual.
    2. A duly authorized representative of the school or school group promoting the contest must sign a declaration and release form confirming acceptance of the prize as awarded, confirming compliance with the terms and conditions and releasing Operation Dialogue and other Contest Sponsors from any liability before receiving the prize.
    3. All taxes, issuance fees or other charges arising from acceptance of the prize and not described herein as included in the Prize are the sole responsibility of the winner.


    Notification

  31. Scholarship Prize Winners

    Students will find out if they have won by logging on to their account on Friday, February 29, 2008. Winners names will be posted publicly on our website at www.talkaboutcanada.ca and www.discussionsurlecanada.ca once all students have answered the mathematical skill-testing question and returned their required documents.

  32. Junior Prize Winners

    Students will find out if they have won by logging on to their account on Friday, February 29, 2008. Winners names will be posted publicly on our website at www.talkaboutcanada.ca and www.discussionsurlecanada.ca once all students have answered the mathematical skill-testing question and returned their required documents.

  33. Registered Schools

    The names of the ten winning schools will be posted on the Operation Dialogue web-site on Friday, February 29, 2008 by 5:00 P.M. Eastern Standard Time at www.talkaboutcanada.ca and discussionsurlecanada.ca and may be published elsewhere.


  34. General Provisions around electronic communication


    Internet E-mail

  35. The Internet is not a secure medium and privacy cannot be assured. E-mail communication is not confidential, is subject to possible interception or loss, and is also subject to possible alteration. Operation Dialogue is not responsible for and will not be liable to you or any one else for any harm or damages in connection with e-mail, containing personal or confidential information sent by you.

  36. Third Party Links

Links to other Websites are not endorsements or approvals of such sites, the third parties named therein, or their products and services, nor is any liability assumed for incompatibility, non-suitability, viral infection, worms, Trojan horses or other destructive/disruptive components on or from such sites. Linking to another site is at your sole risk and Operation Dialogue and other Contest Sponsors are not responsible or liable for any damages in connection with linking.

  38. Any attempt by a contestant or any other individual to deliberately damage any website or undermine the legitimate operation of the contest is a violation of criminal and civil laws and should such an attempt be made, Operation Dialogue and other Contest Sponsors reserve the right to seek damages from any such contestant or other individual to the fullest extent permitted by law.

  39. Disclaimer of Liability

Operation Dialogue and other Contest Sponsors will not be liable for any incorrect or inaccurate information, whether caused by the contestants or by any equipment or programming associated with or utilized in the contest, or by any technical or human error which may occur in the processing of entries in the contest. Operation Dialogue and other Contest Sponsors will not be liable for any error, omission, interruption, deletion, defect or delay in operation or transmission in connection with the contest, or communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Operation Dialogue and other Contest Sponsors will not be liable for any problems with, or technical malfunction of, any telephone network or lines, computer on-line systems, servers or providers, computer equipment, software, or failure of e-mail which may occur for any reason whatsoever, including technical problems or traffic congestion on the Internet or at any website or combination thereof, including injury or damage to participants' or to any other person's computer related to or resulting from participating or downloading materials in this contest. Operation Dialogue and other Contest Sponsors are not responsible in any way for any damages (direct, indirect, special, incidental, economic, or consequential, exemplary or punitive) in respect of or in connection with the contest, the awarding of the prize, or the inability to use the Website, the information, or any action or decision made by you or any one else in reliance on the Website or the information, or any unauthorized use or reproduction of the Website or the information.

  41. If, for any reason, the contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the reasonable control of Operation Dialogue and other Contest Sponsors which corrupt or affect the administration, security or proper conduct of this contest, Operation Dialogue and other Contest Sponsors reserve the right at their sole discretion to, without advance notice, terminate or suspend the contest, in whole or in part, or modify it in any way without liability. In no event will Operation Dialogue and other Contest Sponsors be liable for any incidental, consequential, special or indirect damages even if Operation Dialogue and other Contest Sponsors have been advised of the possibility of such damages.
